Legal Warranty
Ilatro guarantees the end consumer against any manufacturing defect or non-conformity of the products that exists at the time of delivery and manifests itself within 2 (two) years from the date of delivery. Articles 128 to 135 of the so-called “Consumer Code” apply to every order or contract made. Ilatro recommends that the end consumer always keep a copy of the purchase-related documents, such as the order, invoice, delivery note, etc.
Ilatro guarantees the user that the products sold are not defective and that they comply with the order specifications, meaning, in particular, that the products:
– Match the description provided on the website and possess the qualities of the products presented by Ilatro, as well as correspond to the quantity requested by the consumer at the time of the order;
– Are suitable for the purpose for which goods of the same type are normally used;
– Have the quality and performance that are customary for goods of the same type and that the user can reasonably expect, considering the nature of the product.
For technological reasons, Ilatro cannot guarantee that the display of colors on the screens of the devices used to access its website will always be accurate, complete, and up to date.
Likewise, minor differences between the description or representation of the product on the website and the actual characteristics of the product itself will not be considered as grounds for non-conformity in relation to the order.
Non-Conforming Product
If a non-conforming product is delivered, the user may request the restoration of its conformity through repair or replacement, where possible. The repair or replacement of the products must take place within a reasonable timeframe agreed upon by the parties, in accordance with applicable law, taking into account the nature of the product and the purpose for which it was purchased.
If repair or replacement is objectively impossible (including due to the extent of the non-conformity and the possibility that an alternative remedy may be carried out without significant inconvenience to the consumer) and/or entails excessive costs for Ilatro under applicable law, and/or if the previous repair or replacement has caused significant inconvenience to the consumer, the user shall have the right to request a corresponding reduction in the purchase price or the termination of the contract (or order) and a refund of the purchase price and (if applicable) shipping costs. All costs necessary to restore product conformity, including shipping costs, will be fully covered by Ilatro.
Without prejudice to the fact that Ilatro is responsible for non-conformity defects existing at the time of delivery and manifesting within 2 (two) years after the delivery of the product, any legal action to enforce defects not fraudulently concealed by Ilatro must be initiated within 26 (twenty-six) months from the delivery date, without prejudice to the final consumer’s right to assert non-conformity defects that have been reported in a timely manner.
Warranty Exclusions
The warranty does not cover damages caused by product misuse, improper handling, accidents, water, solvents, wear and tear, damages caused by carriers, or any other damages resulting from external factors that are not attributable to non-conformities existing at the time of delivery.
The Ilatro warranty does not cover deterioration due to regular use, damages caused by improper use of the product (e.g., carrying unusual objects), exposure to heat, contact with acids or solvents, water infiltration, or transport-related damages. The Ilatro warranty also does not cover damages caused by airline carriers.
When retrieving baggage after a flight or train journey, please inspect it carefully, and if it has been mishandled, immediately file a claim with the airline. Most major airlines are willing to cover damages resulting from mishandled baggage.
The legal warranty is reserved for consumers and therefore applies only to users who have made a purchase on the website for purposes unrelated to their business, commercial, craft, or professional activities.
Improper or incorrectly performed maintenance or repairs will void the warranty.
Warranty Activation and Returns Procedure
The user must notify Ilatro of any product non-conformity through Ilatro’s customer service by sending an email to the following address: info@ilatro.com.
The warranty is granted only and exclusively after the defect has been reported and upon presentation to Ilatro of one of the following documents, which are essential conditions for accessing the service: the warranty certificate included in the packaging with the purchase date confirmed by the retailer’s stamp, the purchase receipt, the invoice, or the e-commerce order code.
Before sending the product to Ilatro, the user must complete the designated return request form in its entirety and send it via fax or email to Ilatro’s customer service. The form must necessarily be accompanied by one of the aforementioned documents. Only after the correct and complete receipt of the required documents will Ilatro issue a return authorization number, which the user must affix to the package containing the returned product. Warranty requests submitted in a different manner will not be accepted.
Return shipping costs will be borne by the customer. The mere receipt of the products by Ilatro following the activation of the above procedure does not, in any way, imply Ilatro’s acknowledgment of a product non-conformity, as a thorough verification by Ilatro is required.
Return Evaluation and Warranty Processing
Upon receiving the returned product, Ilatro will assess the specific case and, if the warranty conditions are met, will proceed with the repair or replacement of the product, reimbursing the customer for the shipping costs incurred.
If the product received by Ilatro is not covered by the warranty, repair and/or replacement may still be carried out at the user’s expense, provided that the product is repairable and/or replacement is possible. In this case, Ilatro will send the user a cost and time estimate for the repair and/or replacement, which must be returned to Ilatro with the user’s acceptance.
Non-warranty repairs will only begin once Ilatro has received the user’s written approval of the estimate.
Payments
Online purchases made on the Ilatro website can only be paid for using a credit card. Payments for orders are processed externally from Ilatro’s systems, meaning Ilatro does not handle or is in any way responsible for the processing of banking data or credit card information used for payment.
Withdrawal
The buyer has the right to withdraw from the contract entered into with Ilatro within 14 business days from the delivery of the products, without any penalty and without providing any reason.
To exercise the right of withdrawal, the buyer must send a written notice within 14 days from the date of receipt of the goods via registered mail with return receipt (A.R.), explicitly stating their intention to return the ordered items. The communication may also be sent via email, provided that it is confirmed with registered mail (A.R.) within the following 48 hours.
The right of withdrawal may be exercised for multiple products purchased, even for only some of them. If the right of withdrawal is exercised, the user must return the purchased goods to Ilatro at their own expense within 14 days from the date of exercising the withdrawal right.
Returned products must arrive at the specified address in perfect condition. The product must be returned in its original packaging with the product tag attached. To proceed with the return, the user must follow the steps indicated in the return procedure. If the withdrawal is not exercised according to the methods specified above, Ilatro will not accept the returned products.
Returns
Returned products must be packed using the original box to prevent damage during transport. If the original packaging is unusable, an equivalent box in size and durability may be used.
Returns shipped using methods other than those specified above will not be accepted, as they are the only authorized return procedures. It is not possible to return products following a withdrawal with shipping costs charged to the recipient.
Once the returned product has arrived at the designated destination, Ilatro will verify the legitimacy of the return. If the return is deemed valid, Ilatro will send the user a confirmation email. Any amounts paid will be refunded via the same payment method used for the purchase within 14 business days.
Damage During Return Shipment
Whether the return is due to the exercise of warranty rights or withdrawal, if the product is damaged during transport, Ilatro will notify the customer so they can promptly file a claim with the courier they selected and obtain a refund. The product will then be made available to the customer, and the withdrawal request will be canceled. Ilatro will not be held responsible in any way for damage, theft, or loss occurring during or as a result of the return shipment, regardless of the reason for the return.
Return shipping costs are borne by the customer and will be reimbursed, where applicable, upon presentation of appropriate fiscal documentation proving the payment.
Disputes
Any sales contract concluded between Ilatro and the buyer under these General Terms and Conditions will be governed and interpreted in accordance with Italian law, particularly the Consumer Code. In any case, any non-derogable rights granted to buyers by the mandatory laws of their country of residence will remain unaffected.
Final Provisions
These Terms and Conditions may be printed or stored on a durable medium, in compliance with Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
If these Terms and Conditions are available in multiple languages, the Italian version shall prevail for interpretative purposes.
